Privacy
I act on behalf of agencies and individuals in relation to privacy incidents and breaches. I advise on the adequacy of compliance programmes in relation to the obligations contained in the Privacy Act 2020 and represent clients before the Privacy Commissioner.
Privacy Act 2020
The Privacy Act 2020 imposes significant obligations on agencies that collect, hold, use or disclose personal information. The Act introduced mandatory privacy breach notification requirements, increased penalties for serious breaches, and strengthened the Privacy Commissioner's enforcement powers. I advise agencies on their obligations under the Privacy Act 2020 and assist with the development and review of privacy compliance programmes.
Privacy Breach Response
A privacy breach can have serious consequences for an agency, including reputational damage, regulatory investigation, and civil liability. I advise agencies on their obligations when a privacy breach occurs, including whether notification to the Privacy Commissioner and affected individuals is required, and how to manage the breach response process. I also represent agencies in Privacy Commissioner investigations and proceedings.
Acting for Individuals
I also act for individuals who believe their privacy rights have been breached. I can advise on the options available to you, including making a complaint to the Privacy Commissioner, and represent you in Privacy Commissioner proceedings and civil litigation.
